Not until early 2010, Jailbreaking becomes legitimate under the DMCA in Usa and several other places like Europe although Apple maintain it to void the warranty. So far Jailbreaking is still developing as new Apple devices or firwares are released.

What's Tethered and Untethered Jailbreak?
